Web Site Launched for Crime Victim in Wake of Attacker's Pre-Emptive Bankruptcy Claim

When someone who has pled guilty to malicious crimes causing bodily injury to others, they can file for bankruptcy to escape ever facing a judge or jury for any civil penalties and force their victims into even greater poverty. Yet the bankruptcy reform legislation currently being considered by Congress does nothing to address this. The case of Pastor vs. Mawhinney may provide one of the clearest illustrations of the problem.On August 2, 2004, Raymond Mawhinney (a.k.a., "Ray Argyle," lead singer of the San Diego-based band "Plastic Explosive" and son of nationally recognized child psychiatrist Dr. Joseph Mawhinney,) pled guilty to a misdemeanor aggravated battery, although he was charged with felony assault and battery with serious bodily injury.

The person he admitted attacking, Douglas Pastor, was hospitalized twice for a total of ten days and endured over a year of life-threatening complications and corrective surgeries, remains unable to work and has become impoverished. Granted parole without supervision, Mawhinney was ordered to pay a token of court costs and to make himself available for all civil case proceedings.However, on March 1, 2005, less than two days before Mawhinney and members of his family would finally testify in deposition, his litigation attorney, Tim Sullivan, of the law firm of Callahan, Little & Sullivan, electronically filed a Chapter 7 petition for bankruptcy on his behalf, which included $145 of the fined court costs as a "bad debt." This action effectively stopped the depositions and all efforts to proceed with the case, because even the most frivolous Federal bankruptcy filing stays attempts to provide an injured person with civil process or civil damages in state courts.Now Pastor is required to spend thousands of dollars to hire yet another attorney, a specialist to represent his interests during the bankruptcy proceedings, just to get permission to proceed with his civil case, and with no guarantee of success or of ever being reimbursed for this attorney's fees, much less any potential award from a civil suit judgment. And if this bankruptcy attorney cannot secure a motion to proceed, Pastor's attacker will be forever protected from facing the consequences of his actions."Many people remember that after his civil trial, O.J. Simpson declared bankruptcy to stay enforcement of the judgment against him," claims attorney Daniel Martorella, of Martorella & Associates. "But now we're seeing defendants in civil cases declare bankruptcy to stop civil trials for bodily injuries before they ever begin.
